Vietnam is a signatory to the Berne Convention on copyright. This sets the minimum protection at 50 years from publication for cinematographic works, photographic works, dramatic works, works of applied art and anonymous works, and at 50 years after the death of the author for other works.
Registration of copyright is advisable and can be made with the National Copyright Office, which is a subsidiary organisation of the Ministry of Culture, Sport and Tourism.
Computer programs are included within copyright legislation in Vietnam where ‘computer programs as such’ cannot be patented.
Copyright is violated on a regular basis in the music, publishing and software industries. HTIC offers client in protecting and enforcing copyrights and similar intellectual property rights as following:
- Advise legal matters of copyright and related rights in Vietnam and abroad;
- Conduct searches and provide information on copyright and related rights, advice measures to protect copyright and related rights in Vietnam and abroad;
- Complete the applications and file to register copyright and related rights;
Enforce the copyright and related rights, including investigation, supervision, negotiation, mediation, lawsuit initiation to handle infringement in Vietnam and oversea.
